Wearly - Terms of Use

1. Agreement to Terms
These Terms of Use (hereinafter “Terms”) constitute a binding agreement between you and Wearly (hereinafter “Company”), which governs your access to and use of the Wearly mobile application (hereinafter “Application”) and its services (hereinafter “Services”).
By using the Application, you agree to these Terms. If you do not agree with any of these Terms, you must not use the Application.
2. License and Usage Rights
Wearly grants you a limited, non-exclusive, non-transferable license to use the Application for personal purposes.
You agree that you will:
Use the Application only for personal and non-commercial purposes
Not copy, modify, edit, use the Application for reverse engineering, decompile or disassemble the Application
Not resell, rent, lease or advertise the Application or any part of it
Not attempt to access the Application if you cannot do so in accordance with these Terms
3. User Account and Registration
In order to use certain Application features, registration and creation of a user account may be required.
You are responsible for:
Providing accurate information when registering
Keeping your password confidential
Maintaining all communication related to your account
Reporting any unauthorized account use incidents to us immediately
You guarantee that when registering, you use only your own name or have the consent of the designated person.
4. Subscription and Payments
Wearly offers premium subscription options with additional features.
Subscription terms:
Subscription is automatically renewed for the set period
Charges will be billed to your Apple ID using Apple Pay
No refunds are available, but you can cancel your subscription in App Store settings
Accounts will be billed 24 hours before the renewal date
Subscription cancellation takes effect at the beginning of the next renewal period
Important: You are responsible for all charges and must provide all required payment information. If payment fails, Wearly may suspend your access to premium services.
5. User Content and Data
In the Application, you may upload personal information, such as photos of your clothes, personal preferences and dressing preferences (hereinafter “User Content”).
Your rights:
You retain all rights to your User Content
You grant us a license to use, process and store User Content to provide the Services
You can delete your account and all associated data at any time
Your responsibility:
You are responsible for ensuring that User Content does not infringe the rights of others
Do not share obscene, illegal or abusive User Content
6. Privacy and Data
Your data processing is described in our Privacy Policy. By using the Application, you agree to data processing in accordance with this policy.
Main data processing:
Photos of clothes and preferences are stored on your device and our servers
We use open weather data from the Open-Meteo service
Subscription information is stored through RevenueCat
Authentication is managed through Supabase OAuth
7. Intellectual Property
The Application content, including all text, images, design, code, algorithms and databases, belongs to Wearly or its licensors.
These Terms do not grant you any property rights to the Application or any part of it, except for the limited license set out in these Terms.
8. Limitation of Liability
The Application is provided “AS IS” and “AS AVAILABLE” without any warranties, whether express or implied.
Wearly disclaims any warranty, including, but not limited to:
Merchantability warranty
Fitness for a particular purpose warranty
Non-infringement warranty
Wearly is not responsible for:
Direct, indirect, incidental or consequential damages
Data loss or corruption
Business losses or lost revenue
Interruption or malfunction of third-party services (such as Open-Meteo)
Important: You use the Application at your own risk. You should verify recommendations from the AI stylist personally before wearing in unusual situations or important events.
9. Release of Liability
You agree to release and indemnify Wearly from any claims arising from your use of the Application or User Content that may violate or infringe these Terms.
10. Term and Termination
These Terms are valid as long as you use the Application.
Wearly may terminate your access without prior notice if you:
Violate any provision of these Terms
Use illegal or abusive content
Disrupt Wearly services
11. Modification of Terms
Wearly may from time to time modify these Terms. We will notify you of significant changes through the Application or email.
Your continued use of the Application after changes indicates your agreement with the new Terms.
12. Apple Notice
You agree that:
You must comply with Apple’s terms of service
Your subscription will be managed through the Apple App Store
Apple is not responsible for Wearly services or any content
You should request a refund through Apple Account Settings, not through Wearly
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law principles.
Any disputes arising from these Terms or the use of the Application shall be resolved in the Vilnius City Arbitration Court in accordance with the applicable laws of Lithuania.

15. Miscellaneous
If any provision of these Terms is invalid or unenforceable, the remaining provisions remain fully valid.
These Terms constitute the entire agreement between you and Wearly regarding the Application and Services, and supersede any prior or concurrent agreements.
